No matter how many assets and how much property you may own, estate planning is important because it allows you to plan for many of life’s contingencies before they occur. You are able to distribute your assets as you desire and not as state statutes would mandate. It protects your privacy and keeps your children and beneficiaries out of probate court. Estate planning also allows you to decide who can make decisions on your behalf if you become incapacitated and are unable to speak for yourself. Moreover, estate planning gives you the opportunity to establish guardians and conservators for minor and/or incapacitated children. Additionally, estate planning allows you to set up a special needs trust for disabled, handicapped and/or any other beneficiaries that will not interfere with them receiving government assistance. Included in an effective estate planning package is a revocable (living) trust, wills, healthcare and financial powers of attorney.
